president fail to reach a deal, the impact is as unlikely as immediate as the term "fiscal cliff" seems to imply. the expiration of the tax cuts with a $2200 average tax high. the payroll tax cut would also expire meaning another $40 a paycheck and long-term unemployment benefits would end for 2 million americans. while these elements could have a recession-inducing effect, they could undo those measures shortly after the first of the year. estimations are if we do go over the cliff it would be the third quarter which the recession may hit. when be look at the issue of a -- the markets, however, may feel the brunt of the fiscal cliff fallout. the dow fell on friday after the deal failed the night before. last week fitch warned it may downgrade the u.s. credit rating if congress cannot reach a deal. some lawmakers are angling for the best political outcountry. >> when i listen to the president, i think he's eager to go over the cliff for political purposes. he gets all this additional tax revenue for new programs, gets to cut the military which democrats have been calling for for years,

santelli, thank you. the fiscal cliff talks also weighing on the energy markets. let's go to bertha coombs at the nymex. >> we are seeing a little bit of a pullback here when it comes to brent futures, and also across the board pretty much in energy today. not what you would necessarily expect with the weaker dollar. the concern, of course, is that if we do go over that fiscal cliff, no deal by the end of the year. that we will see some recessionary pressures here in the first quarter. at least that's what the congressional budget office is talking about. nat gas is feeling the pressure after a strong rally over the last couple of days. we're getting profit taking there. ironically, it comes after the commitment of traders report from the cftc saying we saw the biggest increase in terms of net long positions in nymex futures. gold holding steady. not necessarily being the big safe haven play. but it is among the strongest performers in the metals complex. we are seeing some strength in po laid yum and platinum. that according to rbc because of a new etf there. >> thank you very much

[ laughter ] ashley: gold is always gold. gentlemen, thank you so much for joining us for the floor show. i am going to ask santa for some gold as well. hopefully washington is asking santa for a fiscal cliff feel. both sides come back to work on thursday. peter barnes is in washington. how likely that we get a deal done? peter: the speaker and the president have not spoken since friday. right now, all eyes are on the senate. the president proposed a limited patch that would a void the cliff after speaker boehner scuffled his plan be. staff discussions continue between the administration and the hill. we have not heard of any breakthroughs at this point. democrats extended tax breaks for families taking under $250,000. that would cost $157. it also approved taxing $92 billion. mitch mcconnell is critical to hammer out a deal in the senate because he can filibuster anything. his spokesman said "nothing new to report. we do not know yet what senator reed plans to bring to the senate for a vote." >> if you want leaders, then, you have to lead. the president has been a pathetic leader.

is still no deal to avoid the fiscal cliff. so what is an investor to do with their money right now? >> let's bring in our guests and our own bob pisani. good to see you guys. thanks for joining us. kevin, what is your take in terms of investing into year end and going into 2013? >> i just think you have to be realistic about the fiscal cliff issue. we don't know what the magnitude of the damage is going to be to gdp next year but what we do know is that the current track run in terms of fiscal sustainability just isn't right. we can't run trillion dollar deficits for a year and expect to get away with that long term. so i think there is a trade-off here in terms of some penalty to growth next year. longer term there are benefits though and going into the year i think you just have to have maybe a little cash in the portfolio but be looking to put money to work in companies that are going to survive, good balance sheets and consistent profitability. stocks are cheap relative to bonds so i don't want to get too defensive here. >> you were with us at the top of the hour and made clear you were on hold until you see something about a fiscal cliff resolution of some kind.
